TO THE FULLEST EXTENT PERMITTED BY LAW, INAGENAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNTS PAID BY YOU TO INAGENAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless InagenAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration or, where arbitration is not available, in the courts of competent jurisdiction. You agree to submit to personal jurisdiction in such courts.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InagenAI regarding your use of the Service and supersede all prior and contemporaneous agreements, representations, and understandings.
